The purpose of this confidentiality policy is to inform users of the site www.maison-scarlett.fr (hereinafter the “Site”) of the way in which their personal data is collected, used and protected by the company BXM Ecommerce SAS, operating the Scarlett House.

2. Personal data collected

Maison Scarlett collects the following data:

Data provided directly by the user

When creating an account, an order, subscribing to the newsletter or a contact:

  • Last name, first name

  • Postal address and e-mail

  • Phone number

  • Billing and delivery information

  • Order history, returns, after-sales service requests

  • Communication preferences

Data collected automatically

When browsing the Site:

  • IP address, device type, browser used

  • Connection and navigation data (pages visited, duration, clicks, etc.)

  • Cookies and trackers (see §10)

Payment data

Payments are processed by our service providers Shopify Payments, Stripe, Mollie PayPal and Klarna.

Maison Scarlett does not keep any banking data; these are directly transmitted securely to these PCI-DSS approved service providers.

3. Purposes of processing

The data collected is used to:

  • Process and deliver orders, provide after-sales service;

  • Manage customer relations and requests via the contact form or email;

  • Send marketing communications (emails, SMS, personalized advertisements);

  • Improve the operation of the Site and measure advertising performance;

  • Fight against fraud and ensure payment security;

  • Comply with legal and tax obligations.

The treatment is based on:

  • execution of the sales contract,

  • consent (in particular for commercial prospecting),

  • legitimate interest (analysis, statistics, fraud prevention).

4.Data recipients

Personal data is intended only for Maison Scarlett and its authorized subcontractors in the context of site management, orders and marketing:

  • Shopify (e-commerce hosting and back-office)

  • Klaviyo (marketing emails, newsletters and automations)

  • Meta (Facebook/Instagram) and Google (targeted advertising and performance measurement)

  • Stripe, Klarna, PayPal (secure payment)

  • Colissimo / La Poste / partner carriers (delivery)

  • Accounting, legal or technical service providers bound by confidentiality

No personal data is sold to third parties.

5. Data retention period

Maison Scarlett retains personal data only for the period necessary for the purposes for which they were collected, and in compliance with legal obligations.

The data linked to the customer account is retained as long as the account is active, then for a period of three years from the last activity or last contact.

The data relating to orders and invoicing are kept for ten years, in accordance with accounting and tax obligations.

The data used for commercial prospecting purposes (newsletter subscription, email campaigns, advertising) are kept for three years from the last contact from the customer or prospect.

Finally, the browsing data (cookies and tracers) are kept for a maximum period of thirteen months, in accordance with the recommendations of the CNIL.

At the end of these periods, the data is either deleted or irreversibly anonymized.

6. User Rights

In accordance with the General Data Protection Regulation (GDPR) and the Data Protection Act, everyone has the following rights:

  • Right of access to your data;

  • Right of rectification of inaccurate data;

  • Right of erasure (“right to be forgotten”);

  • Right to limit processing;

  • Right to object to the processing of your data, in particular for prospecting purposes;

  • Right to portability of one's data.

Maison Scarlett may request proof of identity before executing the request.

A response will be provided within 1 month maximum.

In the event of a dispute, the user can file a complaint with the CNIL (www.cnil.fr).

7. Security and Privacy

Maison Scarlett implements appropriate technical and organizational measures to protect data against loss, unauthorized access, disclosure or destruction (SSL encryption, secure hosting, restricted access, regular backups).

However, no system is infallible and absolute security cannot be guaranteed.

8.Data transfers outside the European Union

Certain data may be transferred outside the European Union, in particular to Shopify (Canada/United States), Meta, Google or Klaviyo (United States).

These transfers are carried out within the framework of standard contractual clauses approved by the European Commission, guaranteeing a level of protection in accordance with the GDPR.

9. Commercial prospecting

Maison Scarlett may send its customers or prospects information and commercial offers:

  • by email, SMS or via social networks,

  • subject to explicit consent or an existing business relationship.

The user can unsubscribe at any time by clicking on the unsubscribe link present in each message or by writing to contact@maison-scarlett.fr.

10. Cookies and trackers

The Site uses cookies to improve the user experience, measure the audience and offer personalized advertising.

Types of cookies used:

  • Cookies necessary for the operation of the site (Shopify, shopping cart, customer account)

  • Analytical cookies (Google Analytics, Meta Pixel)

  • Cookies marketing (Google Ads, Meta Ads, Klaviyo, TikTok Ads if applicable)

During the first visit, a cookies banner allows the user to accept, refuse or configure their preferences.

Consent is valid 13 months maximum and can be withdrawn at any time via the link “Manage my cookies” or from the browser settings.
