General Conditions of Sale & Legal Notices

Preamble

These general conditions of sale (hereinafter the “CGV”) apply to all sales concluded on the Maison Scarlett website.

The website www.maison-scarlett.fr is a service of:

The website Maison Scarlett markets the following products: jewelry boxes, watch boxes, jewelry holders, jewelry displays and accessories.

The validation of an order constitutes unreserved acceptance of these general conditions of sale.

Article 1 – Principles

These General Terms and Conditions express the entirety of the obligations of the parties.

They apply to the exclusion of all other conditions and are accessible on the Maison Scarlett website, where they prevail over any other contradictory document.

The seller reserves the right to modify its General Terms and Conditions from time to time; they are applicable as soon as they are put online.

Article 2 – Scope of application

These General Terms and Conditions govern the online sale of goods offered by the seller from the Maison Scarlett site, for deliveries to the countries offered at the time of ordering on the site. Eligible areas, delivery times and costs are specified when validating the basket.

For any delivery request outside these areas, the customer can contact contact@maison-scarlett.fr.

Article 3 – Pre-contractual information

The buyer acknowledges having received, prior to ordering, all the information provided for in article L.221-5 of the Consumer Code, in particular the essential characteristics of the good, the price, costs, delivery times and terms, legal guarantees, and the conditions for exercising the right of withdrawal.

Article 4 – Order

Orders are placed online, while stocks last.

To be validated, the buyer must accept the T&Cs, indicate the delivery address, choose the shipping method and validate the payment.

The sale becomes firm and definitive:

  • after order confirmation sent by e-mail,

  • and after full collection of the price.

In the event of non-payment, incorrect address or anomaly, the seller may suspend the order until the problem is resolved.

Article 5 – Electronic signature

Final validation and provision of payment data constitute electronic signature and express acceptance of the order and these General Terms and Conditions.

Article 6 – Order confirmation

An order confirmation is sent by e-mail after validation of payment.

Article 7 – Proof of the transaction

The computerized records, kept in the seller's systems under reasonable security conditions, constitute proof of communications, orders and payments between the parties.

Article 8 – Products

The products offered for sale are those appearing on the site, while stocks last.

They are described and presented with the greatest possible accuracy, but the photographs are not contractual.

Article 9 – Price

Prices are indicated in euros, all taxes included, excluding delivery costs.

Shipping costs are specified before validation of the order.

The seller reserves the right to modify its prices at any time, while guaranteeing the price in effect at the time of the order.

In the event of changes to taxes or contributions, these changes may be reflected in prices.

Article 10 – Payment and retention of title

10.1 Payment methods

Payment is due in full on the order.

The accepted means of payment are: bank card (Visa, Mastercard, Amex...), ApplePay, PayPal and Klarna (split or deferred payment according to conditions displayed).

The seller may refuse any order in the event of a prior payment dispute.

10.2 Security

Payments are processed by approved service providers, via secure protocols.

10.3 Reservation of title

The seller retains ownership of the goods until full payment of the price.

The transfer of risks occurs upon delivery.

Article 11 – Availability and deadlines

Shipping times begin on the date the order is registered on the confirmation email.

For products in pre-order, the indicative deadline is specified on the product sheet; failing this, it may not exceed 30 days unless otherwise agreed.

In the event of delay, the buyer may order the seller to perform within a reasonable additional period; failing this, he may terminate the contract.

Reimbursement of sums paid takes place within 5 days maximum.

If a product is unavailable, the buyer is informed and can request refund or exchange.

Case of end-of-year holidays:

Any order placed before December 18 will be delivered before Christmas.

Orders placed after December 18 are made with knowledge of delivery times that may be extended.

Article 12 – Delivery

Delivery corresponds to the transfer to the customer of physical possession or control of the goods.

The products are delivered to the address indicated when ordering; any errors or omissions in this address are the responsibility of the buyer.

Any package returned for an incorrect address will be reshipped at the buyer's expense.

In the event of absence, a notice of passage is left.

If the package arrives damaged, the buyer must:

  • refuse delivery or issue specific reservations on the slip,

  • inform the seller without delay.

All returns must be requested within 60 days of delivery.

The products must be returned complete and intact (packaging, accessories, instructions), and we cover the return costs.

Deliveries outside the EU (e.g.Switzerland): import duties and taxes are the responsibility of the recipient and cannot be refunded.

Article 13 – Delivery errors / non-compliance

Any claim of error or non-compliance must be made on the day of delivery or at the latest on the first following working day, by e-mail to: contact@maison-scarlett.fr.

The seller will then assign a returns number.

All returns must be made in the original packaging, complete and in good condition.

Article 14 – Legal guarantees

14.1 Guarantee of conformity (Consumer Code)

The seller is responsible for any lack of conformity in the conditions of articles L.217-3 to L.217-14 of the Consumer Code.

The consumer has 2 years from delivery of the goods to act and can choose between repair or replacement, except for disproportionate cost.

He is exempt from proving the existence of the defect within 24 months following delivery of the new good.

14.2 Guarantee against hidden defects (Civil Code)

In accordance with articles 1641 et seq. of the Civil Code, the buyer can act within a period of 2 years from the discovery of the defect and choose between resolution of the sale or a reduction of the price.

14.3 Commercial guarantee

Any possible commercial guarantee is indicated on the product sheet concerned and is in addition to the legal guarantees above.

Article 15 – Right of withdrawal (60 days)

The consumer has a period of 60 days from receipt to exercise his right of withdrawal, without having to justify himself.

Products must be returned in their original condition and complete, allowing them to be remarketed in new condition.

Damaged or incomplete products are not returned.

The request can be sent by e-mail to contact@maison-scarlett.fr.

In the event of exercising the right of withdrawal:

  • the price of the product(s) and the initial “standard” delivery costs are refunded;

  • the return costs remain the responsibility of the customer.

    The refund will be made within 14 days from receipt of the returned products.

Products offered as part of an order

When the order resulted in the granting of one or more free products (promotional gifts, items offered in a pack or a special offer), their return is obligatory with the returned product(s).

Failing this, the refund will be refused or reduced by the commercial value of the products offered not returned.

Exceptions (art.L221-28 of the Consumer Code): personalized goods, unsealed for hygiene reasons, digital content executed before the end of the deadline, etc.

Article 16 – Force majeure

Any external, unpredictable and irresistible event suspends the obligations of the parties.

If the force majeure event lasts more than 3 months, either party may terminate the contract.

Article 17 – Intellectual property

The elements of the site (texts, images, graphics, logos, videos, sounds, etc.) are protected and remain the exclusive property of the seller.

Any unauthorized reproduction or use is prohibited.

Article 18 – Personal data (GDPR)

The personal data collected on the site are processed by BXM Ecommerce SAS as processing manager, for the following purposes:

  • order processing and tracking,

  • delivery, payment, customer management and fraud prevention,

  • commercial prospecting (with consent),

  • statistical analyses.

The data is kept for the duration of the contractual relationship, then archived according to the legal durations (5 to 10 years).

The recipients are the technical service providers (Shopify, payment providers, carriers, CRM, etc.).

The user has rights of access, rectification, deletion, limitation, opposition and portability, which he can exercise at the address: contact@maison-scarlett.fr.

Possible complaint to the CNIL.

Article 19 – Partial nullity

The nullity of a clause does not entail that of the entire contract.

Article 20 – Non-waiver

The fact that a party does not rely on a breach does not constitute a waiver of this right.

Article 21 – Titles

Headings are inserted for convenience and do not alter the interpretation of the clauses.

Article 22 – Language

These General Conditions of Sale are drawn up in French language.

In the event of translation, only the French version is authentic.

Article 23 – Consumer mediation

After prior written contact with our customer service (contact@maison-scarlett.fr) which remains unresolved, the consumer can contact the competent consumer mediator free of charge:

Mediation is free for the consumer, takes place in French, and is carried out in accordance with articles L.612-1 to L.616-3 of the Consumer Code.

The consumer remains free to accept or refuse the proposed solution.

Article 24 – Applicable law and jurisdiction

These General Terms and Conditions are subject to French law.

In the absence of an amicable solution, disputes fall under the competent jurisdiction of the seller's head office, unless mandatory legal provisions to the contrary.

Access to the site and its use are reserved for strictly personal use. The user undertakes not to use the site for commercial, advertising or illegal purposes.

Site content

All brands, photographs, texts, illustrations and other content present on the site are protected by intellectual property law.

Any reproduction or use without authorization is prohibited.

Responsibility

The seller cannot be held responsible:

  • site interruptions or malfunctions,

  • material damage linked to the use of the site,

  • any illicit or misappropriated use of the content of the site.

The user is solely responsible for his equipment, his connection and his use of the site.

Hypertext links

The establishment of links to the Maison Scarlett site is authorized subject to a prior request to contact@maison-scarlett.fr.

Any unauthorized redirection must be removed upon simple request.
